Terms of Business

This document sets out the terms upon which we provide veterinary services, including acupuncture. This is an important document and should be retained for future reference. These terms and conditions apply to all current and future work unless otherwise agreed in writing.

In this document, “we”, “us”, and “our” refer to James Carrier trading as The Pain Vet, Warwickshire under J L Carrier MRCVS Limited. “You” refers to the client or clients engaging our services. Where we act for more than one client, we are authorised to act on the instructions of any one of them.

TREATMENT HOURS

These will be determined by caseload and will be confirmed with you at time of booking.

CONSENT TO TREATMENT

By instructing us to provide veterinary services, you consent to the examination and treatment of your animal as deemed appropriate based on clinical judgement. This may include manual therapies and acupuncture where indicated. We will endeavour to discuss treatment options and obtain informed consent; however, you acknowledge that clinical decisions may need to be made in the best interests of the patient at the time of treatment.

CLIENT CONFIDENTIALITY

The veterinary surgeon/client relationship is founded on trust and guided by the Royal College of Veterinary Surgeons Code of Professional Conduct. All client and patient information is treated as confidential and will not be disclosed to third parties without your consent, except where required by law, for referral and ongoing care, or where necessary to protect animal welfare.

PRIMARY VETERINARY CARE

We do not replace your primary care veterinary surgeon. Responsibility for your animal’s overall healthcare remains with your registered veterinary practice. You agree to keep your primary veterinary surgeon informed of any treatment provided by us where appropriate, and we may share relevant clinical information with them with your consent.

OWNERSHIP OF RECORDS

We retain, as our property, all clinical records. Any veterinary surgeon or veterinary paraprofessional involved in a case may be forwarded copies of relevant records but only upon the request or consent of the client. Please refer to our Privacy Policy for further information.

INSURANCE

We support the principle of insuring against unexpected illness or injury. Please note that responsibility for payment of fees remains with you, and any agreement with your insurance provider is separate from this contract. Claims should be settled directly with your insurer unless otherwise agreed in advance.

FEES & PAYMENT TERMS

All fees are payable on the day of treatment, unless otherwise agreed in advance. Fees are based on professional time, expertise, and any consumables used. A schedule of fees is available online. Payment may be made by credit/debit card, cash, or BACS. For BACS payments, please refer to your invoice. Any queries relating to an invoice must be raised within 14 days of the invoice date.

LATE PAYMENT

Accounts not settled within 14 days of the invoice date may incur interest at a rate of 2.5% per month. If a payment is declined, reversed, or found to be invalid, the outstanding balance will be reinstated and may be subject to additional administrative or bank charges.

NON-PAYMENT

We reserve the right to take appropriate steps to recover outstanding balances, including the use of debt collection agencies or legal proceedings. Reasonable recovery costs may be added to the outstanding balance. We also reserve the right to withdraw services in cases of non-payment, with written notice where appropriate.

CANCELLATION POLICY

We understand that circumstances may arise requiring appointment changes. We request a minimum of 24 hours’ notice for cancellations. Late cancellations or missed appointments may incur a fee. Full details are outlined in our Cancellation Policy.

COMPLAINTS

We aim to provide a high standard of care. If you have any concerns, please contact the Director in the first instance so that we can address the issue promptly.

DATA PROTECTION

We process personal data in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018. By engaging our services, you consent to the use of your data for the purposes of providing veterinary care. Please refer to our Privacy Policy for full details.

CLINICAL RISK

While all reasonable care is taken in the provision of our services, all veterinary treatments carry an inherent level of risk. By consenting to treatment, you acknowledge and accept that complications, side effects, or unexpected outcomes may occur.

LIABILITY

All services are provided by J L Carrier MRCVS Limited. Any claim arising in connection with the services provided must be made against the company and not against any individual Director, employee, or consultant in their personal capacity. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, or for any other liability which cannot be lawfully excluded or limited. Clinical outcomes cannot be guaranteed and may vary between patients.

GOVERNING LAW & JURISDICTION

These terms are governed by the law of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
